The role of the expert witness is to act as a teacher, providing an educational bridge between the Justice System and the technical world. As the volume of litigation in this country increases, and the issues at hand in court cases become more and more complex, experienced expert witnesses who can convey the technical information to the judge and jury are in higher and higher demand. Municipal, county and state Flood Control Agencies and Public Works Departments are involved in flood related litigation all the time and their engineers and administrators are frequently called on to testify. Ethics and ethical considerations come into play with every aspect of being an expert witness. This Workshop will be presented in two sessions. Attendees can attend either one or both sessions, as the subject matter of each of the sessions is not interdependent.
1. The first session will cover the expert witness “basics:” The Role of the Expert Witness in Litigation, The Litigation Process and Dealing with the Client Attorney and Preparing for and Giving Effective Deposition and Trial Testimony.
2. The second session will cover Expert Witness Ethical Practices: Ethical Promotion of Litigation Support Services and the Expert’s Contract. Various litigation scenario examples involving ethical decisions to be made by the expert will then be presented and discussed.
